Militia Laws

Constitutional Law, State Codes, and Legal Statutes for West Virginia and Ohio.
Note: We are an unorganized Citizens Group not a military company or organization.
Military service is NOT a requirement for membership in the Militia.
US CODES:
TITLE 10 > Subtitle A > PART I > CHAPTER 13

§311. Militia: composition and classes
(a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.

(b) The classes of the militia are—

(1) the organized militia, which consists of the National Guard and the Naval Militia; and

(2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.

WV Codes:
§15-5-19. Unorganized militia.
The unorganized militia shall, at the call of the governor, be available for duty with the emergency service forces of this state. For purposes of this article, the unorganized militia shall consist of all able-bodied men and women between the ages of sixteen and fifty.

§15-1F-7. Unlawful military organizations.
It shall be unlawful for any body of men whatever, other than the regularly organized national guard or the troops of the United States, to associate themselves together as a military company or organization in this state: Provided, That the governor may grant permission to public or private schools of the state to organize themselves into companies of cadets, and may furnish such cadets, under proper restrictions, such obsolete ordnance stores and equipment owned by the state as are not in use by the national guard. Whosoever offends against the provisions of this section, or belongs to or parades with any such unauthorized body of men with arms, shall be punished with a fine of not exceeding one hundred dollars or imprisoned for a term not exceeding six months.

§15-5-19a. Possession of firearms during a declared state of emergency.
No powers granted under this article to state or local authorities may be interpreted to authorize the seizure or confiscation of a firearm from a person during a declared state of emergency unless that firearm is unlawfully possessed or unlawfully carried by the person, or the person is otherwise engaged in a criminal act. 

Applicable Laws concerning Militias in OH.
The Ohio Constitution:
Article IX 1 Who shall perform military duty. All citizens, residents of this state, being seventeen years of age, and under the age of sixty-seven years, shall be subject to enrollment in the militia and the performance of military duty, in such manner, not incompatible with the Constitution and laws of the United States, as may be prescribed by law. (As amended Nov. 7, 1961.)
  The Ohio Revised Code:
5923.01 Composition and organization of state militia; definitions; troop limitation.

(A) The Ohio organized militia consist of all citizens of the state who are not permanently handicapped, as handicapped is defined in section 4112.01 of the Revised Code, who are more than seventeen years, and not more than sixty-seven years, of age unless exempted as provided in section 5923.02 of the Revised Code, and who are members of one of the following:

(1) The Ohio national guard;
(2) The Ohio naval militia;
(3) The Ohio military reserve.
(B) The Ohio national guard, including both the Ohio air national guard and the Ohio army national guard, the Ohio naval militia, and the Ohio military reserve are known collectively as the Ohio organized militia.

(C) The Ohio naval militia and the Ohio military reserve are known collectively as the state defense forces.

(D) The unorganized militia consists of those citizens of the state as described in division (A) of this section who are not members of the Ohio organized militia.

(E) No troops shall be maintained in time of peace other than as authorized and prescribed under the "Act of August 10, 1956," 70A Stat. 596, 32 U.S.C.A. 101 to 716. This limitation does not affect the right of the state to the use of its organized militia within its borders in time of peace as prescribed by the laws of this state. This section does not prevent the organization and maintenance of police.

  1. Can I ask why the age of 45? Em still way under that but why 45? I know some 50 year old's that could run circles around me and would still consider joining. What then?

  2. The age requirements also vary according to State Constitutions. These provisions state when a citizen is required to serve. They do not exclude volunteers outside the age range.

  3. Every militia unit has a "home front" that they defend. Typically a geographical area such as a town, county, state, assigned area or general area of operations. All the citizens within that area are defended by their militia and are also a ready source of backing that provides matériel and assistance of many types.

    Voluntary housing or needed shelter... even a shed in the back yard can keep rain off a head. Food, medical supplies, a home-cooked meal... so many things that the citizen non-militia member can provide.

    I belong to no militia but consider myself part of the general unorganized militia providing support via the written and spoken word. The Web allows the common folks to communicate in a way once reserved for the wealthy elites of which too many have, I fear, become tyrannical in their actions.

    Even if you are not an official "card-carrying" member of your local militia offer your services and assist as the unit allows. If for whatever reason they neither want nor need your support assist in whatever legal manner you deem helpful for the cause. I defend the militia at message boards and comment sections across the Web. I also have several blogs where I support the militia cause.

    I am here to write this due to researching for one of my blogs that lists militias across the USA. This site will be included today. If curious it can be viewed at the link below in a 1/2-hour or so.

I wanna join so bad.i tell ya why when the government sends out those troops,That's the day they don't care about are rights as Americans we have the right to bare arms to protect are family's and America.they are going to send as many family's to the fema,Not today brothers I will die for WATS right and it's to protect.but me not having any weapon's really sucks but hopefully before the planet is over took I will have weapons..

  13. I will go as far as saying, That no matter what has been posted about the Militia of the several states up to this point is mute. If anyone here needs or wants to know more about the militia go to www.constitutionalmilitia.org The national guard is a adjunct to the military which excludes them from being called as militia. The militia members are trained by military but do not have anything to do with the military.
